Pursuant to Section 2.74 0 (c) of the Commission's Rules, the Department hereby moves for a protective order.

Interroaatorv No. 1 Applicant's Intcrrogatory :Jo. 1 requects the Depcrtment to draw precise boundaries on large scale maps of several of the geographic areas involved in this proceeding. The Depart:nent contands 'diat to draw the maps as requested would require a lengthy and c:: pensive series of enginacring and economic studies based on voluminous data not presently cvailable to the Depart-mant. The Department cs timatos that such studies would cost in excess of several hundred thousand dollars.

Moreover, the Department's current answer to Intarro-gatory No. 1 provides sufficient information ro 20? rise Applicant 7 912160 OM

of the general boundarios of the areas in question. It cannot seriously be contended that Applicant is being misled by the i lack of a precise map or. that the precise boundarias of these areas will be an issue in this proceeding.

The Scope of Aoplicant's Document Production Requests Applicant requests that the Department provide "all

] relevant, non-privileged documents presently or hereafter within the possession, custody or control of the Department of Justice . . . . The Department contends that this is a burden-

, some request in that it literally requires a scarch of every i

file folder in the Department of Justice. The Department has made a complete search of all places where it believes dis-coverable material relevant to this proceeding might be found.

T These areas are limited to the offices of the Public Counsel Section of the Antitrust Division. We do not believe that i

any further search would be productive of sufficient material to justify the tremendous expenditure of time and money necessary to conduct it. Accordingly, the Department requests the Eoard to enter a protective order 1) which relieves the Department of its obligation to draw precise maps and 2) which restricts the 4

scope of the Applicant's Document Product Request.
