PROPOSED ISSUANCE OF ORDER AUDIORIZING AN EXEMPTION FROM VIE PROVISIONS OF SECTION 50.10(b) PURSUANT TO SECTION 50.12 0F ThlE C0lt{ISSION'S RULES, TO DUKE POWER COMPANY FOR TIIE OCONEE hyCLEAR STATION, UNITS 1, 2, AND 3, DOCKET NOS. 5 69, 50-270, 50-287 Duke Power Compa&ny has filed an application for licenses to construct and operate the Oconce Nuclear Station, Units 1, 2, and 3, at a site i
near Clemson, South Carolina.
Each unit of the Oconee Station includes a pressurized-water nuclear reactor rated at 2452 MWt.
In a letter dated July 7, 1967, the Duke Power Company requested per-mission to construct the tendon access gallery for Unit No. 1 prior to issuance of a construction permit.
The tendon access gallery installation is required in order to accom-plish laying of the reinforcing steel for the base slab, but does not function as support for the building.
The current request from Duke Power Company is prompted by the estimate that delaying the placing of the gallery would delay the overall construe-tion of the facility for so=e 6 weeks.
The tendon gallery is a part of l
the permanent nuclear facility and its construction prior to issuance of i
a construction pernit is therefore proscribed by 10 CFR Part 50, 50.10(b).
Should this exemption be granted, our past experience would indicate that cany similar requests would be received.
Our review of the exemption request indicates that although the tendon access gallery is a functional part of the containment building from the viewpoint of installation and inspection of the prestrersing tendons, it does not serve as a structural taundation. Geologically, there are no unusual foundation problems at the site, and installing the tendon access gallery would not present a safety problem. 'Iherefore, from a technical viewpoint only, there would be no objection to granting the request. Granting the request would obviate a delay of some 6 weeks in the overall construction of the facility.
