Dear Mr. Osgood:
This is in reply to your letter of August 25, 1979 requesting compensation for the idea submitted to the NRC on March 30, 1979, regarding Three Mile Island Nuclear Station Unit 2.
While the NRC is authorized under the Atomic Energy Act of 1954, as amended, to grant awards to persons making inventions or discoveries "useful in the production or utilization of special nuclear material or atomic energy," the Act indicates that awards can be made only if the invention or discovery is actually used.
In the situation here, your suggestion regarding the addition of special holding tanks was not put into use and, accordingly, no compensation can be made.
