On September 19, 1978, you filed a request for an amendment of License SNM-696 for an exemption from the requirement to submit a safeguards transit contingency plan by September 19, 1978.
Attached was a $150 fee for processing the request.
Our December 22, 1978 letter, copy enclosed, stated that the September 19, 1978 submission was not required. Our Controller's office has;therefore, been notified to refund the $150 fee.

This is in response to your letter 696-978 regarding the requirement for certain licensees to submit a transportation safeguards cont.ingency plan by September 19, 1978.
We have determined that a submission was not required inasmuch as you were not then and have not subsequently been engaged in shipping SNM of the quantities and types covered by 10 CFR Part 73.
However, it should be noted that a plan must be submitted prior to making any such shipment.
