This is in response to your letter 696-978 regarding the requirement for certain licensees to submit a transportation safeguards contingency plan by September 19, 1978.
We have determined that a submission was not required inasmuch as you were not then and have not subsequently been engaged in shipping SNM of the quantities and types covered by 10 CFR Part 73.
However, it should be noted that a plan must be submitted prior to making any such shipment.
