With reference to a telephone conversation between the staff of the Secretary of the Comission and !ny staff regarding the inclusion of a

requirement for qualify 1ps, the equipment needed for cold shutdown in' the_y' subject rule, the staff has the following coments:
1.
The staff's position with regard to cold shutdown is as follows:

The staff requires qualification of all safe shutdown equip-ment consistent with the power plants' licensing bases. For those plants not licensed to cold shutdown, the licensees are required to submit the presently availabic information for one path to achieve the cold shutdown conditions. Regulatory Guide 1.139, which was issued for coments in May 1978, states, "The design shocid be such that the reactor can be taken from normal operating conditions to cold shutdown using only safety-grade systems that satisfy General Design Criteria 1 through l
5."
This position was intended to be applicable for power i
2 plants where the applications for construction permits were docketed on or after January 1,1978. This regulatory guide, i
incorporating the public coments, has not been reissued.
2.
Independent of this rule, if the Conrission determines that the
[
equipment required for cold shutdown should be designed to safety-grade requiranents, qualification of such equipment will be within the scope of the rule.

If th Commission feels that there is a compelling need to include a requirement for qualification of electric equipent for cold shutdown, the following is the suggested paragraph which may be 49 included in the Statenent of Considerations on page 4 of Enclosurt

" Included in the proposed rule is a requirement that each holder of or each applicant for a license to operate a nuclear power plant tr.' required to identify and gttlify the electric equipment necded to complete one path of l
achievirg and maintaininiy a cold shutdown condition."

Section (c) of the proposed rs7c. (page 8 of Enclosure "A"), states in part, "...this section includes electric equipment and systems.
that are essential to... reactor heat removal...." The scope' is general and further modification to include cold shutdown is, therefore, not required.
