APPENDIX A NOTICE OF VIOLATION GeoEgia Institute of Technology License No. R-97 Research Reactor Based on the NRC inspection February 19-22, 1980, certain of your activities were apparently not conducted in full compliance with NRC requirements as indicated below. These items have been categorized as described in correspondence to you dated December 31, 1974.

A.

As required by Technical Specification 6.2.e(5) the Nuclear Safeguards Committee (NSC) shall audit reactor operations and reactor operational records for compliance with internal rules, procedures, regulations, and with licensed provisions including technical specifications.

Contrary to the above, an audit began on 9/7/78 was not completed as of 2/22/80.

This is an infraction.

B.

As required by Technical Specification 6.3.a(1), no experiment shall be performed without review and approval by the NSC and repetitive experiments with common safety considerations may be reviewed and approved as a class.

Licensee procedure 3101 (Operation of Experimental Facilities) defines

" minor" experiments which may be approved by the Reactor Supervisor and Radiological Safety Officer and do not require NSC approval. The procedure definition states in part thet a minor experiment is "any irradiation of non-fissionable, non-explosive material".

Contrary to the above, experiments were irradiated on February 20, 1979, August 8,1979, and September 12, 1979, which contained fissionable material and were not reviewed and approved by the NSC.

This is an infraction.

C.

As required by Technical Specification 6.3.e, there shall be a Quality Assurance Program covering the design, fabrication, and testing of experi-

,ments, including procedures for verification of kinds and amounts of their jmaterial contents.

, Contrary to the above, no such Quality Assurance Progrse was in effect on February 22, 1980.

This is an infraction.

As required by Technical Specification 4.5.a, the emergency core ecoling i

system (ECCS) shall be flow tested monthly.

October 9, 1979 and December 5,1979. The unacceptable flow rate obtained I during the October 9,1979 test was not resolved prior to subsequent reactor i

operation.

This is an infraction. A similar item involving missed surveillance require-ments was brought to your attention in our letter dated December 20, 1978.

E.

As required by Technical Specification 6.7.b, a report shall be made within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> to the NRC regional office of any " abnormal occurrence" as defined t

by the technical specifications. Specification 1.14(c) defines one type of 1

" abnormal occurrence" as "a safety system component malfunction or other component or system malfunction which could, or threatens to, render the safety system or the engineered safeguard system incapable of performing their intended safety functions."

Contrary to the above, on October 9,1979, during surveillance testing, the Emergency Core Cooling System failed to provide the minimum acceptable flow to the reactor core. This potential malfunction of an engineered safeguards system was not reported to the NRC office.

F.

As required by Technical Specification 4.4.a, the pH of the primary coolant shall be measured weekly.

Contrary to the above, this test is not performed weekly and has not been performed on any regular basis as of February 22, 1980.

This is an infraction.

G.

As required by Technical Specification 3.2.a, the reactor shall not be made critical unless the instrumentation listed in Tables 3.1 and 3.2 is operable.

Table 3.2 includes the Kanne Chamber.

Contrary to the above, reactor startups were m.de on January 2,1979, and Jsanuary 3,1979 with the Kanne chamber inoperable.

This is an infraction.

lAs required by Technical Specification 2.2.2, the reactor thermal power H.

Ilimiting safety system setting shall not exceed 1.1 KW when operating in the natural convection mode.

Contrary to the above, the reactor was operated on April 5,1979 and May 24, 1979, in the natural convection mode and the thermal power safety system setting was not reduced from its normal full power setting to 1.1 KW.

This is an infraction.

As requit-4 by Technical Specification 6.7.a, an annual report covering the previous years operation shall be submitted to the NRC regional, o,ffice by March I of each year.

. Contrary to the above, the report covering operations during 1978 was dated j by the licensee March 7,1979, and received by the regional office on March 9, 1979.

This is a deficiency. The report covering operations for calendar year 1979, was submitted before March 1, 1980. Therefore, no response is required to this item.
