Dear Mr. Katz:

This is in reply to your letter dated March 19, 1980, in which you requested, pursuant to the Freedom of Information Act, copies of documents detailing routes and alternate routes through New York State and Pennsylvania for the shipment by truck of spent nuclear fuel from Chalk River, Canada to South Carolina.

In response to your request we' have identified pages 13 through 17 of a letter dated March 21, 1980 to G. L. Stukenbroeker, NL Industries, from G. W. McCorkle, NRC as being subject to your request.

The information contained on these five pages of the above described document identifies the surface transportation routes for safeguarding the licensed special nuclear material contained in the irradiated reactor fuel to be transported.

This information is considered commercial or financial (proprietary) information pursuant to 10 CFR 2.790(d) (copy enclosed) and is being t

withheld from public disclosure pursuant to Exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) (copy enclosed) of tM Commission's regulations.

Pursuant to 10 (JR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The persons responsible for this denial are the undersigned and Mr. John G. Davis, Deputy Director, Office of Nuclear Material Safety and Safeguards.

This denial may be appealed to the Commission's Executive Director for i

Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Conunission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

This completes action on your request.
