Enclosed for your infomation is a copy of the flotice which the Commission has approved for publication in the Federal Register denying the Petition for Rulemaking which the State of flew Hampshire filed simultaneously with the I;uclear Regulatory Connission (NRC Docket fio. PRf12-5), the Council on Environmental Quality, the Environmental Protection Agency, the Sec*etary of the Army, the Secretary of the Interior, the Secretary of State and 'the Secretary of Transportation.
In its petition, the State of l'ew Hampshire requested the Federal agencies to conduct joint proceedings to adopt rules to achieve efficiency in licensing the construction and operation of nuclear power facilities. The State also identified sixteen specific results which it wished to achieve.
The Commission received eleven letters of public comment in response to its Federal Register notice acknowledging receipt of the petition (43 FR 56110-56111, November 30, 1978.) On the basis of these comments and in the light of the current extensive review and evaluation of !!RC licensing requirements and procedures occasioned by the events at Three Mile Island Unit 2, the Commission concluded that the petition should be denied.
