Enclosed for your infomation is a copy of the flotice which the Commission has approved for publication in the Federal Register denying the Petition for Rulemaking which the State of New Hampshire filed simultaneously with the f?uclear Regulatory Comission (flRC Docket flo. PRM 2-5), the Council on Environmental Quality, the Environmental Protection Agency, the Secretary of the Amy, the Secretary of the Interior, the Secretary of State and the Secretary of Transportation.
In its petition, the State of flew Hampshire requested the Federal agencies to conduct joint proceedings to adopt rules to achieve efficiency in licensing the construction and operation of nuclear power facilities. The State also identified sixteen specific results which it wished to achieve.
The Comission received eleven letters of public comment in response to its Federal Register notice acknowledging receipt of the petition (43 FR 56110-56111, flovember 30, 1978.) On the basis of these comments and in the light of the current extensive review and evaluation of NRC licensing requirements and procedures occasioned by the events at Three Mile Island Unit 2, the Comission concluded that the petition should be denied, incerely i JL Samuel J.
