MOTION FOR LEAVE TO FILE AFFIDAVIT BY BROWNSVILLE AS AMICUS CURIAE j The Public Utilities Board of the City of Brownsville, Texas ("Brownsville") hereby moves the Board for leave to file the annexed affidavit by Mr. Robert E. Round tree , its General Manager, to be given such effect as may appear meet;  !

and in support thereof avers:

1. Brownsville is a party to the proceeding below, but has not formally appeared in this appellate proceeding,
although it supports the position of the Department of .

Justice and the Nuclear Regulatory Commission Staf f in opposition to the petition of the three companies.1/ Upon extraordinary motion granted at oral argument on March 27, 1980, Brownsville was permitted, as amicus curiae, to raise 1/ Central and South West Corporation ("C&SW"); Houston Lighting & Power Company ("HL&P"); Texas Utilities Company

("TUGCO").

t in the interests of judicial efficiency, the question of whether these Company-appellants had already substantially consummated a negotiated settlement, thus rendering it unnecessary for the Board to further consider as an issue that the Order below, requiring the production of documents, might jeopardize the reaching of such settlement. The responses by these companies at the oral argument are a matter of records, and, in accordance with Bronwsville counsel's oral statements, the annexed affidavit is submitted.

2. Based upon the statements of a responsible official of Central Power & Light Company, a C&SW subsidiary, it appears that the companies have reached agreement of settle-ment on the basic issue of interstate interconnection; that the proposed settlement has been reviewed with Governors' offices and regulatory commissions of Arkansas, Oklahoma, and Texas, and received favorable comment a, that the federal regulatory agency staff had been contacted with favorable reactions, and that complete settlement is anticipated during the first two weeks of April. This information came to Brownsville's attention after the date for written pleadings, f

two days before oral argument scheduled pursuant to Board Orders, and was not clarified until the next day.

3. Review of the briefs submitted in the above-styled proceeding disclose that a principal position relied upon by

the Company-appellants is that the Licensing Board's con-tested order of production might jeopardize the possibility i

of successful conclusion of the negotiations among the com-panies looking to the settlement of the pending cases.1/ This position was argued extensively.

4. Accordingly, it would appear that, in the interests of judicial efficiency, the Board should consider whether the arguments advanced in connection with the aforesaid issue need be given any substantial weight.

Accordingly Brownsville prays that the Board will enter an order accepting the annexed af fidavit 2/ into the record of j this appellate proceeding.
