PROPOSED LICENSE TO EXPORT SOURCE MATERIAL TO CANADA (XUO8483)
Purpose:
Commission review of proposed issuance of subject license to TNS, Incorporated.
Review Dates:
60-day period expires on February 26, 1980.
l 120-day peri 6d expires on April 26, 1980.
Discussion:
In December 1979, TNS, Inc. applied for a license to export 300,000 pounds of uranium as depleted uranium tetrafluoride (UF4) powder to Eldorado Nuclear in Canada to be used in non-nuclear applications such as shielding and counterweights in North America.
A facility attachment is in effect for the Eldorado Nuclear facility.
Depleted uranium for a non-nuclear end use is not subject to the export licensing criteria in Sections 127 or 128 of the i
Atomic Energy Act of 1954, as amended and 10 CFR 110.42.
Further, such materials fall within the categories of l
materials listed in 10 CFR 110.41(d) which are not normally reviewed by the Executive Branch.

Tne staff has concluded that there are no material changed circumstances concerning exports to Canada which would affect the Comission's consideration of this case and which have occurred since export license : 18414, Amendment No. 01 covering source material for a non-nuclear end use was issued on May 22, 1979.
The following documents are forwarded in connection with the Comission's review of the subject application: (1) application of December 21, 1979 (Appendix A) and (2) copy of proposed license (Appendix B).
NMSS Technical Our understanding is that the exported material (UF4) will be Review:
subject to IAEA safeguards until its fabrication into shielding or counterweights is completed. At this point, Canada will probably request that the Agency terminate the material from further safeguards requirements because of non-nuclear applica-tions. Although NMSS has limited information on the implementation of IAEA safeguards at Eldorado Nuclear, it seems unlikely that this export will involve any unusual or sensitive safeguards issues. The most recent NMSS Technical Assessment of IAEA Safe-guards Implementation in Canada was forwarded to the Commission as SECY-79-310A.
Physical Security criteria contained in 10 CFR Bl 110.42 and 110.43 are not applicable to this export.
Recomendation:
That the Comission authorize the issuance of the proposed license to TNS, Incorporated.
Coordination:
ELD has no legal objection.
NMSS views are as stated above.
