We have received a copy of an application dated February 2,1980, as filed by John D. Leonard, Jr., Resident Manager of the James A. FitzPatrick Nuclear Power Plant, with the Office of Nuclear Reactor Regulation (ONRR) for review and approval. The application proposed changes in the FitzPatrick Technical Specifications relating to primary containment isolation. Your request was not accompanied by a license amendment fee as required by 10 CFR 170.22.

Instead, we were informed that the fee classification and filing per 170.22 would be provided by not later than February 6, 1980. We have not received the referenced fee determination and fee.

Based on guidance from the ONRR staff as a result of a final review of your application, it has been determined that the requested action involved consideration of a single safety issue requiring a Class III fee of $4,000.

It is requested that the fee be forwarded to this office promptly.

It is our understanding that the ONRR staff completed the review of your applica-tion and documented their denial of it in a February 8,1980 ' letter to you.

Although your application was not approved, the review was completed and 10 CFR 170.12(a) states, in part, that "All application fees will be charged irrespective of the Commission's disposition of the application or a with-drawal of the application".
