RESPONSE TO REQUEST FOR INFORMATION (NTFTM 790823-041 Your memorandum of August 23 to Mr. Gossick-requested information regard-

-ing a study being ' conducted by Sandia of the effectiveness of the Standard -

Review-Plan. This study is funded by the Probabilistic Analysis Staff ~

of the-Office of Nuclear R.egulatory Research.

You also requested information regarding safety review work performed by ci. tractors in the past two years. On the basis of Mr. Schroeder's telephone conversation with you, we have interpreted " safety review work" to mean reviews in support of specific docketed applications for CP's or OL's, and have not included generic studies. is a list of contractors and government agencies used in the past two years for casework reviews and an indication of the safety areas involved for each. As you are probably aware, we are presently seeking to expand our use of DOE laboratories and other government agencies for casework assistance in FY 80 as a result of TMI-2 impacts on our resources. We have included at the end of the listing of Enclosure 2, the four labora-tories for which we have already issued program letters to initiate this

. e anticipate that additional arrangements will be made new work.

In response to your questions regarding the use made of the contractors' work products and the supervisory role of the staff with regard to these contracts, we have the following comments.

-The uses made by the regulatory staff of contractors' safety review producte. vary depending on the type of assistance provided. The contracts generally fall into two types:

In the first type, the contractor provides a team of technical personnel

-who review a given area of an application.in accordance with the Standard Review Plan. The objective is to supplement staff resources. The 8 0 01160 7f/

contractors' work products typically consist of draft requests for.

additional'information from the applicant and draft sections of the staff's Safety Evaluation Report. These draft products are reviewed by the regulatory staff, including the Licensing Project Manager, for appropriateness, consistency and general overall adherence to NRC rules, regulations and practices, and are. used in the licensing process in the same way as are-the work products of individual staff reviewers.

. In the second type, the contractor provides specialized expertise needed by the staff in particular technical areas. The work products are usually in the form of reports which are used by the staff in reaching or_ supporting its own conclusions concerning a particular aspect of an application.. Although the staff often provides comments on the contractor's reports in draft, the final work product stands as the independent advice of the contractor. The contractor's report is. incorporated,.

either by reference or by inclusion as an appendix, in the staff's Safety Evaluation Report.

In both types of contracts it is sometimes necessary for contractor

employees to appear as witnesses or provide written testimony at licensing board hearings or ACRS meetings,-to explain or support the work product.

With respect to the " supervisory role" of the regulatory staff, in both cases noted above there is no direct supervision of the contractor or its employees. Rather, what is practiced are the controls found in sound contract administration; namely, defining and interpreting the work requirements and the monitoring of schedules and expenditures of funds.

In addition, as noted above, work products are reviewed and comments provided to assure that NRC regulations and practices are properly followed and that the subject matter has been properly covered in depth, scope and clarity.
