This is to inform you, in accordance with the requirements of the Nuclear Non-Proliferation Act, that NRC has not completed licensing action on your application XMAT0014 to export deuterium to your subsidiary in England.
Your application was received by NRC on October 13, 1978.
We are unable to issue a license on this export request because it does not meet criterion 3 of Section 110.42(b) of our licensing regulations.
Specifically, criterion 3 states that "no such equipment or material will be retransferred without the prior approval of the United States."
To meet this requirement, the Department of State has contacted the government of England with respect to obtaining a generic assurance that no retransfers will be permitted without U.S. approval.
This assurance has not yet been received. We have taken steps, however, to act expeditiously on your license application upon receipt of the assurance.
