In accordance with the discussions among counsel for the parties and members of the presiding Appeal Board during the telephone conference held on February 11, 1980 and the Appeal Board's Memorandum dated February 12, 1980, the NRC Staff has prepared a brief written appraisal regarding the impact of the new infonnation developed by Westinghouse Electric Corp. concerning the risk associated with turbine missiles on the North Anna Units 1 and 2 facility.

This analysis consists of a joint statement prepared by M. Boyle and K. Campe regarding the effect of the new infonnation on their written and oral testi-mony which was presented on the record of this proceeding on June 20, 1979.

(Attachment 1) Copies of their professional qualifications were received into evidence following TR. 580. Also included is a joint statement by W. Hazelton and Y. Noonan regarding the basis of the Staff to allow continued operation of the North Anna Unit I turbine.

(Attachment 2) Copies of Messrs. Hazelton's and Noonan's professional qualifications are also included in this submittal. The Staff anticipated that the above referenced individuals will be available to testify should the Appeal Board hold its tentative hearing on February 21, 1980, and respond to questions from the Appeal Board on the issue. The Staff may call other witnesses as well if a hearing is held.

The Staff is also attaching for the information of the Appeal Board co)ies of a transcript of that portion of the Commission's meeting held on Fe)ruary 13, 1980 which dealt with the turbine missile issue and the recently developed Westinghouse information, as well as copies of the Staff's view slides on the subject which were presented at the meeting.

The Staff is cognizant of the prohibition contained in 10 CFR 69.103 against pleading, citing, or relying upon transcripts of Commission meetings or the statements of views or expressions of opinion made by the Commissioners or the Staff at such meetings in any proceedings pursuant to 10 CFR Part 2.

Accordingly, while the Staff is providing this material for backg*ound and informational purposes, should a hearing be held on the turbine missile issue, the Staff will not plead, cite or rely upon the attached transcript or the statements of views or expressions of opinion made by the Commissioners or the Staff at the Commission's February 13, 1980 meeting. Rather, any necessary information will be provided in the fonn of direct testimony by appropriate Staff witnesses.
