This is in response to your letters dated August 20, 1979 and September 7, 1979 which informed this office of changes to the exit search procedures at one of your material access areas and a reduction in holdings of stra-tegic special nuclear material (SSNM) at the Vallecitos site.
We have reviewed the changed search procedures and agree that, in consider-ation of the size and shape of the special nuclear material involved, there is no decrease in the effectiveness of the searches. The change is therefore acceptable.
We agree that as a result of your reduction in holdings of SSNM below the level set forth in 10 CFR 73.1 you are no longer required to follow the Physical Protection Plan for the remaining material. We have determined that this change also does not decrease the effectiveness of your plan and is acceptable. Please note that you will be required to submit a plan relative to your remaining holdings under the provisions of 10 CFR 73.47.
If at any time you intend to reintroduce SSNM in quantities at or above the level set forth in ! 73.1,it wili be necessary to have an approved plan for such quantities in force. We are hereby cancelling Sections 9 and 10 of Materials and Plant Protection Amendment MPP-2 to your License No. SNM-960 and issuing revised Sections 9 and 10 as follows, effective inmediately.
9.0 Physical Protection Requirements 9.1 The licensee shall not possess or use at the Vallecitos Nuclear Center special nuclear material in quantities specified in 10 CFR 73.1(b)(1) until a detailed plan as described in ! 70.22(h) of 10 CFR Part 70 has been submitted, and approved by the Nuclear Regulatory Commission.
