By letter dated November 21, 1979, you stated your objection to our October 30, 1979 request for an additional $4,400 in fees pursuant to 10 CFR Part 170 for your Technical Specification Change Request No. 61 dated September 26, 1979, for Point Beach Units 1 and 2.

The additional fees were for that portion of your application relating to the reporting level for the Radiochemical Engineer and Health Physicist.

The Nuclear Reactor Regulation (NRR) technical staff recently reviewed your position as set forth in your November 21 letter, and have advised us that they have also completed the review of the subject change in reporting level. As a result of these reviews, it has been determined that the previously requested Class III and I fees are still appropriate and due.

The review by the technical staff of the proposed organizational changes was required to assure that the position of radiation protection manager would not be buried so deep in the organization that his freedom to discuss important aspects of his job with the highest level of management would be impaired. Therefore, the change is not considered strictly administrative nor pro forma in nature. Organizational changes that only change names or titles and not functions, departments or levels of reporting are generally considered administrative or pro forma and only require Class II fees.

On the basis of the above, it is requested that your Company forward the

$4,400 to this office within fifteen (15) days after your receipt of this letter.
