ACKNOWLEDGMENT FOR THE RECEIPT OF THE U.S. DEPARTMENT OF ENERGYS RESPONSE TO THE NUCLEAR REGULATORY COMMISSIONS REQUEST FOR ADDITIONAL INFORMATION ON THE 2017 DRAFT GROUNDWATER COMPLIANCE ACTION PLAN: THE RIFLE, COLORADO, NEW PROCESSING SITE

Dear Ms. Jasso:

By letter dated January 19, 2017 (Agencywide Document Access and Management System

[ADAMS] Accession No. ML171023A222), the U.S. Department of Energy (DOE) submitted to the U.S. Nuclear Regulatory Commission (NRC) staff for review and concurrence a Draft Groundwater Compliance Action Plan (GCAP) for the New Rifle, Colorado, Processing Site.

The NRC staff reviewed DOEs GCAP and, on July 21, 2017, informed DOE that additional information was needed to complete staffs review (ML17159A552). By letter dated September 26, 2019, DOE provided responses to NRCs request for additional information (ML19273A429).

The purpose of this letter is two-fold. First, this letter is used to formally acknowledge receipt of DOEs responses. Second, in keeping with NRCs recent practice to improve transparency with licensees, this letter provides a tentative schedule for the next milestone. Based on the format of DOEs responses (addressing each RAI individually without enclosing a revised GCAP), the next milestone is anticipated to be NRCs review of DOEs response. Our schedule is to complete the review of the RAIs by February 7, 2020. If the responses adequately addressed the staffs RAI, then a letter will be sent to DOE requesting a revised GCAP. If the RAI response is determined to be inadequate, then a letter will be sent to DOE documenting any inadequacy.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
