  • 3 g ',;g NUCLEAR REGULATORY COMMISSION r,

WASHINGTON, D. C. 20555 g *-..../

February 14, 1980 Mr. Floyd W. Lewis, Chairman Ad Hoc Nuclear Oversight Comittee Middle South Utilities, Inc.

Box 61005 New Orleans, Louisiana 70161

Dear Mr. Lewis:

As a followup to our phone conversation, I am writing to apprise you of current activity regarding the restart of Three Mile Island, Unit 1 (THI-1).

On July 2,1979, the Comission ordered that THI-1 remain in a cold

~

shutdown condition until further order by the Comission and stated that a public hearing would be held prior to restart of THI-1. The Comission expressed its belief that public participation was a vital ingredient in matters related to THI-1 restart plans.

On August 9,1979, the Comission issued an additional Order on TMI-1 specifying the basis for the Shutdown Order and the procedures to govern the hearing regarding restart. On the basis of this hearing, the Comission will determine whether any further operation of THI-1 will be permitted and, if so, under what conditions.

I have enclosed a copy of the August 9,1979, Order for your information.

The Comission's Order also identifies a number of items that must be resolved prior to restart. These items, which are listed on pages 5-7 of the Order, include but go beyond those required for restart of other Babcock & Wilcox-design pressurized water reactors similar to TMI Units 1 and 2.

These additional items included those recomended by the Lessons Learned Task Force, which studied the TMI accident.

The Comission carefully considered the time required for completing all tasks related to the Order and called for expeditious handling of the necessary NRC staff and procedural actions required for the hearing process.

(A Comission Schedule is provided on the last page of the Comission's Order.) Because of delays related to a large volume of information required from the licensee, to be analyzed by the staff, and substantial participation in the hearing, we have not been able to maintain this schedule.

NRC recently issued a status report on o' r evaluation of Het Ed's compliance with the August 9,1979, Order.

I am enclosing a copy of the status report for your information. We have yet to complete our 8003060

s Floyd W. Lewis

-2 February 14, 1980 evaluations, but based on Het Ed compliance to date, we anticipate that in a future supplement to our evaluation we can make the finding that THI-1 can be operated without endangering the health and safety of the public.

I am pleased to provide you with this information.

If you have any questions, please contact me at (301) 492-7347.

Sincerely.
