Dear Mr. Smith:

Pursuant to Section 2.201 of the Nuclear Regulatory Commissions (NRC's)

" Rules of Practice", Part 2, Title 10, Code of Federal Regulations, the following information concerning items identified during Inspection No. 79-19 is hereby submitted.

Infraction 10 CFR 71.3, " Requirement for License," states, "No licensee subject to the regulations in this part shall (a) deliver any licensed materials to a carrier for transport or (b) transport licensed material except as authorized in a general license or specific license issued by the Commission, or as exempt in this part."

10 CFR 71.12 establishes a general license for delivery to a carrier for transport:

" (b)

In a package for which a license, certificate of compliance or other approval has been issued by the Commission's Director of Nuclear Material Safety and Safeguards or the Atomic Energy Commission, provided that:

The person using a package pursuant to the general license provided by this paragraph:

(i)

Eas a copy of the specific license, certificate of compliance, or other approval authorizing use of the package and all documents referred to in the license, certificate, or other approval, as applicable..."

Contrary to the above, on September 19, approximately 9.0 Curies of radioactive waste material were delivered to a carrier for transport v1.thout authorization of a general or specific license, and no exemption to 10 CFR 71 was applicable, as copies of all documents referenced by the Certificate of Compliance were not available.

Response

According to the Nuclear Records Section of Connecticut Yankee, the inspector asked to see the book on shipping container LL-50-100.

There was a misunderstanding between the inspector and Nuclear Records in that the inspector thought that LL-50-100 book was complete including the drawings. Nuclear Records did not realize the inspector wanted to see the drawings also.

The drawings are stored separately from the certificate of compliance and were not shown to the inspector.

Nuclear Records confirmed that the drawings are on site.

The referenced supplements, dated October 21, 1977, November 23, 1977, November 29, 1977 and March 9, 1978 were not on site for the inspector's viewing.

Subject documents have been obtained from Chem-Nuclear.

However, supplement dated October 21, 1977 was in fact issued October 13, 1977.

Connecticut Yankee is now in total compliance with certificate of compliance for shipping container LL-50-100.
