Dear Mr. Barrett:

This is in response to your letter dated January 14, 1980 in which you requested, pursuant to the Freedom of Information Act:

All records, documents, and materials of any kind disclosing, discussing, concerning or related to (1) the decommissioning, dismantling, disassembly or cessation of operations of the Babceck and Wilcox facility at Apollo, Pennsylvania; (2) any investigations, analyses, studies, tests or measurements per-formed in connection with the decommissioning, dismantling, disassembly, or cessation of operations of said facility; and (3) the discovery or lack of discovery of any special nuclear material in any form in or on the equipment, piping, or structure of said facility.

In response to your request, the documents listed in Appendix A are being placed in the NRC Public Document Room (PDR) 1717 H Street, N.W.,

Washington, DC 20555.

You may obtain access to these documents by presenting a copy of this letter or by requesting folder F01A-80-18 in your name.

The documents listed in Appendix B have already been made available for public inspection and copying at the PDR.

The charge for reproducing records located in the PDR is eight cents (50.08) per page, as specified in 10 CFR 9.14(a) of the Commission's regulations.

Documents 13 and 14 and portions of documents 1 through 12, 15, 16 and 17 listed in Appendix C contain information which identifies procedures for safeguarding licensed special nuclear material or detailed security measures for the physical protection of a licensed facility or plant.

This information is considered commercial or financial (proprietary) information pursuant to 10 CFR 2.790(d) and is being withheld from public disclosure pursuant to Exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations.

The non-exempt portions of documents 1 through 12,15,16 and 17 are being placed in the PDR.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. John Davis, Acting Director, Office of Nuclear Material Safety and Safeguards.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
