ORDER SUSPENDING CERTAIN CONSTRUCTION ACTIVITIES AT THE THREE MILE ISLAND NUCLEAR GENERATING STATION On November 29, 1971, the Director of Regulation of the Atomic Energy Commission issued an Order to Show Cause directed to Metropolitan Edison Company and Jersey Central Power and Light Company (the licensees),
to show cause why construction activities involving the off-site portion of the transmission lines for Three Mile Island Nuclear Generating Station Unit 2 should not be suspended pending completion of a review of the environmental impact of such activities under the Comission's regulations implementing the National Environmental Policy Act of 1969 (NEPA),10 CFR Part 50, Appendix D.
A determination that such construction activities should be suspended pending completion of the NEPA environmental review had been made by the Director of Regulation upon consideration of the licensee's written statement of reasons (with supporting factual submission) dated October 19, 1971, why the construction permit should not be suspended, in whole or in part, pending completion of the NEPA environmental review, and upon consideration and balancing of the criteria set out in section E.2 of Appendix 0 of 10 CFR Part 50. . were set out in a document entitled " Discussion and Findings by the Division of Reactor Licensing, U. S. Atomic Energy Comission, Relating to Consideration of Suspension Pending NEPA Environmental Review of the Provisional Construction Permits for the Three Mile Island Nuclear Generating Station Units 1 and 2, Metropolitan Edison Company, and Jersey Central Power & Light Company, Dockets Nos. 50-289 and 50-320, November 22, 1971," which was appended to and made a part of the Order to Show Cause.
The Order to Show Cause provided that an answer might be filed and a hearing demanded within thirty (30) days of the date of the Order to Show Cause. On December 28, 1971, the licensees filed a timely answer requesting reconsideration and withdrawal of the Order to Show Cause.
The licensees have not demanded a hearing.
Upon consideration of the licensees' answer, it has been deter-mined that cause has been shown for reconsideration and withdrawal of the Order to Show Cause only to the extent it applies to lines other than the Juniata line. The reasons for this determination are discussed in the appended document, "Supalement to Discussion and Findings by the Division of Reactor Licensing, U. S. In view of the foregoing, and pursuant to the Commission's regulations in 10 CFR Parts 2 and 50, Appendix D, IT IS HEREBY ORDERED THAT, construction activities involving the off-site portion of the Juniata transmission line for the Three Mile Island Nuclear Generating Station Unit 2 shall be suspended until further order of the Com-mission. This order is effective upon service.
