SUMMARY
OF A PUBLIC MEETING WITH NUCLEAR DEVELOPMENT, LLC, REGARDING REQUEST FOR CONSTRUCTION PERMIT TRANSFER AND RELATED ACTIVITIES FOR THE BELLEFONTE NUCLEAR PLANT ON OCTOBER 3, 2019 The U.S. Nuclear Regulatory Commission (NRC) staff held a Category 1 public meeting with Nuclear Development, LLC (ND) on October 3, 2019. The purpose of the meeting was to introduce the members of ND and to discuss the submittal of NDs August 28, 2019, supplement to their November 13, 2018, request to transfer the deferred construction permit for Bellefonte Nuclear Plant (BLN) Units 1 and 2, and related changes. The meeting started at 12:30 p.m. and ended at 1:15 p.m.

V. Hall Summary of Meeting:
The NRC staff conducted a Category 1 public meeting at the request of ND, to introduce plans associated with BLN Units 1 and 2, located in Hollywood, Alabama. Following the kickoff of the meeting, Mr. Bill McCollum the Chief Executive Officer and Chief Nuclear Officer of ND gave a presentation. Mr. McCollum addressed the following topics and general plans for BLN:
- The NRC staffs April 5, 2019, request for supplemental information needed acceptance of the application for construction permit transfers and conforming administrative amendments identified the quality assurance (QA) program, technical qualifications, and the consent of the current licensee. Mr. McCollum addressed that ND addressed these topics in its supplement to the application.
- Mr. McCollum also stated that he believed ND was financially qualified.
- Mr. McCollum stated that, based on their belief that ND adequately addressed the topics discussed in NRCs request for supplemental information, that NRC should continue the acceptance review in parallel with the current litigation with Tennessee Valley Authority (TVA) to ensure that the project activities stay timely to support NDs plans.
At the end of the ND presentation the staff asked questions on the topics of QA, technical qualifications, and future plans for Bellefonte. ND responded that the QA plan was based on the current version of the TVA QA plan for BLN including commitments to Title 10 Code Federal Regulations (10 CFR) 50.54 at a level similar to decommissioning facilities. On the technical qualifications question, ND responded that they have agreements involving scopes that reflect the step-wise approach going forward. ND plans to start the project at a deferred status and then revise the contracts and agreements for construction, accordingly. On the question of schedule, ND responded that the detailed schedule is proprietary and that they anticipate resolution of the litigation, and then it will take several months for the construction permit transfer review, at which time engineering work will begin.
Following the staffs questions, there was an opportunity for the public to provide comments and ask questions. There was a question from a member of the public on Department of Energys (DOE) loans and power purchase agreements as well as the status of the lawsuit with TVA.
The staff stated that the NRC and DOE do not discuss the status of DOE loans as they are independent entities with differing responsibilities. The staff notes here that it has no more information on the status of the lawsuit between ND and TVA than was provided in NDs presentation.
