Dear Mr. Chairman and Members of the Board:

As Counsel for People Against Nuclear Energy (PANE), we recently received the Brief of Consumer Advocate of Pennsylvania on Impact and Form of Psychological Distress Evidence. This brief discusses the extent of the Board's discretion to limit or control both the parties' choices of witnesses to address issues of psychological distress and cross-examination of those witnesses.

Because PANE's contentions relate exclusively to psychological distress, PANE is vitally interested in the questions addressed by the Consumer Advocate. However, PANE believes that those questions are not yet ripe for discussion since the Board and the Commission have not yet admitted the psychological distress contentions. Questions of how evidence may be presented have no bearing on whether the contentions should be admitted.

Accordingly, PANE will make no substantive response to the Consumer Advocate's brief tat this time. We reserve the 1787 277 soo %

In addition, PANE requests that the Board defer consideration of the questions raised by the Consumer Advocate and of any similar questions until after the psycho-logical distress contentions have been admitted to this proceeding.
