E* NoidiS/ Company Vice President lietropolitani 19603 Post Office / vania Reading idigt De in reply to your request, dated July 19,1967, for an jfion from the provisions of Section 50.10(b),10 CFR Part 50 As Coanission's rules, pursuant to Section 50.12 9f the rules, permit the performance of certain work at the sita of the n.ree Mile Island Nuclear Station Unit 1 prior to the issuance of a con-struction permit by the Commission.

You state that the pouring of concrets for the tendon access gallery,

which will be located below the ais cont =%t mat, must be author-ized before you can proceed with strtain other pre-construction work such pa pouring the concrete nud sat to provide a working surface in the bottom of the reactor building excavation and the placement of reinforcing bart for the reactor building base slab. You further state that scheduling of the construction of the gallery is important to permit adherence to your schedule for coc:pletion of the plant.

We have carefully reviewed your request described in your July 19th letter, for an exemption under the provisions of Section 50.10(b) and the reasons set forth in support thereof, and have concluded that the granting of the proposed exemption is authorized by law, will not endanger life or property or the common defense and security and is otherwise in the public interest..1ccordingly, the Commission hereby authorises you to construct the tendon access gallery for Unit 1 at the Three Mila Island Nuclear Station site, as requested in your letter of July 19, 1967, prior to the issuance of a construction permit.

Neidig NOV2 9 567 I wish to emphasize that the granting of this exemption shall have no bearing upon the subsequent granting or dunial of a construction permit for the proposed Three Mile Island Nuclear Station Unit 1, and any work performed pursuant to this exemption shall be performed entirely at the rish of Metropolitan Edison Company. Furthermore, the granting of this exemption does not constitute an approval of the type or adequacy of the method of its installation.
