UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION BEFORE THE ATOMIC SAFETY AND LICENSING BOARD In the Matter of S HOUSTON LIGHTING & POWER COMPANY S Docket No. 50-466 (Allens Creek Nuclear Generating S Station, Unit 1) S INTERVENORS MOTION FOR EXTENSION OF TIME FOR DISCOVERY BY CARRO HINDERSTEIN AND BRENDA MCCORKLE Brenda McCorkle and Carro Hinderstein request the Commission to extend the period for discovery from April 2, 1979 as ordered in the February 16, 1979 Order signed by Sheldon Wolfe, Chair, Atomic Safely and Licensing Board Panel, to May 2, 1979, pursuant to 10 CFR $2.730. For good cause, Intervenors show the following.

1. In the interest of fair play, a full development of all the contentions at issue is necessary in order to accomplish the objectives of the planned prehearing conference, as outlined in the Order dated February 16, 1979, by Mr.

Sheldon Wolfe. This will not be possible with the present deadline because:

a. In view of the let'ter dated March 16, 1979, from Mr. Wolfe regarding barging the reactor pressure vessel, a time extension is needed to give the addressees and the Board the chance to determine whether Hinderstein Contention 3 and TEXPIRG Additional Contention 1 should 2234 082 7906010093

E be admitted as an issue in controversy. If either one or both are admitted, discovery time must be allotted for the Applicant and the Intervenors.

b. Mr. John Doherty has been admitted as a party in an Order dated March 15, 1979 by Mr. Wolfe, and has been given a discovery deadline of April 17, 1979.
c. The final supplement to the Safety Evaluation Report has not been published and/or distributed.

This document has a direct bearing on McCorkle's safety related Contention 10, jointly with TEXPIRG Contention 6, which has been admitted as an issue in controversy.

In the interest of justice this document must be reviewed by the aforementioned intervenors.

2. Intervenors plan to file interrogatories on the already admitted contentions up to the April 2, 1979 deadline, and want to give the Applicant 30 days to produce documents.
3. Intervenors Carro Hinderstein and Brenda McCorkle need to study the documents and other information from the Applicant and the NRC Staff that will be forthcoming.
4. All Intervenors present and Richard Lowerre, Assistant Attorney General for Texas requested a discovery period of 76 days during the conference call February 15, 1979.

(Mr. James Scott of TEXPIRG was unavailable for the conference call.)
