Exxon Nucle'ar Company, Inc. has requested a license to import 40,000 kilograms of uranium, enriched to 3.1% U-235, as UF, from the USSR 6
for fuel fabrication in the Exxon facility at Richland, Washington.

This specification package has been reviewed and approved by NRC for various size UF6 cylinders in protective overpacks.
E The UF6 is cwned by Rheinisch-Westfaliscks Elektrizitatswerk, West Germany.
Any subsequent reexogrt of the material will be the subject of a separate licensing action.
The import of UF6 has been the subject of Comission review on many occasions in the past, for example, under licenses ISNM01686 (SECY-77-179), and ISNM01697(SECY-78-107).

for those previous cases are applicable, also, to (continued) the case at hand and the staff finds this importation will not be inimical to the common defense and security or constitute an undue risk to public health, safety and to the environment.
The following documents are forwarded for Commission review of the subject application:
(1) Application of January 25, 1979 at Appendix A and (2) Copy of proposed license at Appendix B.
NMSS Technical Review:
NMSS notes that the applica-tion does not identify the destination of any subsequent export.
Accordingly, it is itnpossible at this time to provide any information concerning the adequacy of safeguards to be applied to this material upon any subsequent export.
OIP Comments: With respect to the proposed reexport of material involved here, IP notes that, if this occurs, it will be the subject of separate Executive Branch and NRC reviews of statutory requirements, including the safeguards aspects.
The applicant is aware that license authority for an import does not imply that a proposed subsequent export will be approved.
Recommendation:
That the proposed import license be issued to Exxon Nuclear Company, Inc.
Coordination:
0 ELD has no legal objection.
Because the ultimate destination of the material is unknown, NMSS is unable to ascertain whether there are any foreign physical security or IAEA safeguards issues associated with this import.

Import License Application - Special Nuclear Material
Dear Mr. Oplinger:
Exxon Nuclear Company, Inc. hereby applies for a license to import Special Nucicar Material in the amount of 40,000 kilograms of uranium enriched to a maximum of 3.1 wt.% U-235 from the Union of Soviet Socialist Republic.
Upon import into the United States, the material will be intro-duced into the fuel fabrication processes at our Richland, Washington facility.
The information required by 10 CFR 110.34 is provided in three copies attached to this letter.
