This refers to your apolication dated March 15, 1979 for renewal of Special Nuclear Material License SNM-1459 which expired on February 28, 1979. This license had permitted N L Industries to possess loaded packages approved pursuant to 10 CFR Part 71 for the purpose of delivery to a carrier for transport and in private carriage between licensed facilities within the United States.

We have reviewed the sJbject application and find that N L Nuclear would not have effecti/e possession of the radioactive material because the packages are loaded by the facility licensee.

Therefore, your application of March 15, 1979 for renewal of Special Nuclear Material License No. SNM-1459 is denied.

Pursuant to the Commission's " Rules of Practice," Title 10, Code of Federal Regulations, Part 2, you may request a formal hearing in this matter by filing a written request with the Office of the Secretary, United States Nuclear Regulatory Commission, Washington, D. C.
