This refers to the inspection conducted by Ms. Jean Dawson of this office on February 9,1979, of the activities authorized by NRC Byproduct Material License No. 25-01706-03 and to the discussion of our findings held by Ms. Dawson with Dean Walter Hill, Dr. W. Van Meter and Mr. K. Read on February 9, 1979.
The inspection was an examination of the activities conducted under the license as they relate to radiation safety and to compliance with the Commission's rules and regulations, and the conditions of the license.
The inspection consisted of selective examinations of procedures and representative records, interviews of personnel, independent measurements and observations by the inspector.
The inspector also reviewed the action you had taken with respect to four items of noncompliance observed during our previous inspection, which was conducted January 20 and 21',1976.
She verified that the corrective action with respect to three of these items was implemented as stated in your replies of February 24 and March 12, 1976, to our letter dated February 4, 1976.
However, it was observed that one item of noncompliance had recurred during the period covered by this inspection.
The recurring item of noncompliance and reference to the pertinent requirements are listed as item 1 of the enclosed Notice of Violation.
We are concerned about the implementation of your program for management control of your licensed activities that permitted this infraction to recur.
Consequently, in your reply you should describe, in particular, those actions taken or planned to improve the effectiveness of your management control of the requirements of your license.
Based on the results of this inspection, it appears that certain of your activities were not conducted in full compliance with NRC requirements, as set forth in the Notice of Violation, enclosed herewith.
These items of noncompliance have been categorized into the level as described in the correspondence to you dated December 31, 1974.

University of Montana February 23, 1979 This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.
Section 2.201 requires you to submit to this office, within twenty (20) days of your receipt of this notice, a written statement or explanation in reply including:
(1) corrective actions which have been taken by you and the results achieved; (2) corrective actions which will be taken to avoid further items of noncompliance; and (3) the date when full compliance will be achieved.
