Dear Members of the Board:
Enclosed for your information is a copy of a letter (which was originally transmitted by telegraph) dated March 9,1979, to the Nuclear Engineering Company (NECO) from the Director, Nuclear Material Safety Safeguards.
The NRC Staff will promptly file its response to NEC0's request of March 8, 1979, that this Board dismiss the Sheffield proceeding.
Because of the change in circumstances, and the commonality of issues, the Staff will address the matters on which we had originally requested and received leave to file a reply brief (Board Order of February 27, 1979) in our response to NEC0's latest filing.
In that the Board has previously scheduled an oral argument in this proceeding for March 27, 1979, it is requested that the March 8,1979 motion of NECO also be heard at that time.
