ORDER By petition dated January 28, 1979, the Carolina Environmental Study Group (CESG) requested that the Comission reopen the safety phases of the licensing proceedings for Duke Power Company's Catawba Nuclear Station and McGuire Nuclear Station.1/ The Director of the Office of Nuclear Reactor Regulation has referred the CESG request regarding the McGuire facility to the Atomic Safety and Licensing Board since the matter of issu nce of the operating licenses for the McGuire facility is currently pending before this Board.El 1/eeattachment.

S 1 ecause no proceeding concerning the Catawba Nuclear Station is cur-B rently pending before any Licensing or Appeal Board, the Director is treating CESG's request to reopen the Catawba proceeding as a recuest under Section 2.206 of the Comission's regulations.

N 2-The basis of the CESG request which we are treating as a motion to reopen the record, is the contention that new information--a revised estimate of peak requirements--would alter the' cost / benefit balance for the facility. CESG further contends that if there is no need for these units, the acceptance of the level of risk projected during pre-vious proceedings is not justifiable. Moreover, since, allegedly, cer-tain safety matters have not been adequately dealt with, if the risks of these factors were correctly assessed, the level of risk would be even higher and even less justifiable.

Applicant and Staff are requested to file an answer to the above-identified motion within ten (10) days and fifteen (15) days, respectively, after service of this Order.

It is so ORDERED.
