On-. December 4,.1978,, the Atomic Safety and Licensing Board (ASLB) in the above-captioned docket notified this t tervenor of the " opportunity to intervene with regard to environmental issues" involved in the ASL3's forthcoming hearing on applica-tion for a construction permit for Palo Verde Plants 4 and 5.

On June 9, 1978, California petitioned the Commission for Leave to Participate in this case in general as an interested state under Section 2.715(c) of the Commission's Rules of Practice and Procedure) (10 CFR Section 2.715(c)).

II As a " representative" of this " interested state" counsel for California asserts that it desires to participate in the hearing under Paragraph 2.?l5(c, on the environmental iscues involved in this proceeding as vell as any other issue it believes pertinent to its interests.

III California further asserts it is unable to determine from the December 4 Order of the ASLB whether this interested state need file a separate Petition for Leave to Intervene in the environmental issues of this proceeding or whether our Petition of June 9 would suffice for that purpose.

If addi-tional Petition was-intended ~and necessary, California desires this pleading to be construed as California's request of the ASLB to be given opportunity to participate in the proceedings regarding the environmental issues to be determined in this matter without requiring that we take a position with respect to those issues, as afforded by Section 2 715(c).

WHEREFORE, California requests leave to intervene with respect to the environmental issues to be litigated and determined in this proceeding.
