SUMMARY

. Week Ending January 26, 1979 Surry Units 1 and 2 The Steam Generator Repair Program for Surry Units 1 and 2 was approved on January 20, 1979.

It is expected that Surry Unit 2 will be shut down on ' January 26 to begin the repairs.

10 CFR Part 50.55a A proposed amendment to 10 CFR Part 50.55a, Codes and Standards, was published in the Federal Register.

The amendment incorporates, by reference, the 1977 Edition of the ASME Code and Addenda section that deals with inservice inspection of nuclear reactor components.

Radiation Exposure Information In response to a request.from a statf member from Governmental Activities and Transportaticn Subcommittee of the house Committee on Government Operations, SD is providing information on whether the radioactive material shipments in regular commercial flights may affect pregnant passengers.

Value/ Impact Analyses On January 24,1979, the ED0 issued instructions to the staff regarding rulemaking(papers sent to the Commission.1) the. availability and opportunity fo These instructions will improve:

value/. impact analyses associated with rulemaking papers and (2) uniformity and quality of the resolution of public comments on rulemaking papers.

Power Burst Facility The Power Burst Facility ran a control-rod-system-type test on December 1 to determine the effect of burnup on the failure threshold of four pre-irradiated fuel rods subjected to reactor transients.

The preliminary test report said that there was general retention of the integrity of the four rods.

International Safeguards On January 25, an IP representative attended the first formal meeting of the NRC Safegu?rds Agree.nent Implementation Group, formed to coordinate implemen~tation of the US/IAEA Safeguards Agreement.

The principal topic was_ the progress of proposed Part 75 to implement the Agreement for licensees.

Plain English Pilot Project: Editorial Review of F0IA Regulation Provided the.ED0 with a report on rewriting regulations in plain English.

The report suggests establishing a training program for personnel who

' write regolations, organizing a writing / editing group, and defining an initial program for rewriting ~ regulations.

0FFICE OF STANDARDS DEVELOPMENT IMPORTANT EVENTS FOR THE WEEK ENDING JANUARY 26, 1979 1.

A proposed amerdment to 10 CFR 5 50.55a, Codes and Standards, was published in the Federal Register which would incorporate, by reference, the 1977 Editiu of Section XI of the ASME Code and Addenda through the 1978 Addenda.Section XI deals with inservice inspection of nuclear reactor components.

Editions of the Boiler and Pressure Vessel Code are issued every th'ree years and addenda to the~ editions are issued on a semi-annual basis.

It has been a continuing policy of the Commission to update Section 50._55a as the referenced codes are revised.

However, adoption of the addenda following the Summer 1975 Addenda to Section XI (and the 1977 Edition, which incorporated the addenda through the Winter 1976 Addenda) was delayed perding the resolution of NRC concerns with several provisions considered unacceptable.

Those changes, which reduced the amount of examination required, would tend to lower the effectiveness of inservice inspection programs for nuclear power plants. These addenda and the 1977 Edition would be acceptable for incorporation by reference into the regulations only with appropriate modifications that would retain those requirements considered necessary for an inservice inspection program.

In this regard, the Summer 1978 Addenda do provide such modifications to Sectiorr XI of the ASME Code. The examination requirements removed from the code by previous addenda, but still required by the regulations, have either been restored.or have been superseded by provisions considered by NRC to be improvements or acceptable alternatives to the previous requirements.

In light of the changes made in the Summer 1978 Addenda, the proposed amendment. would. incorporate by reference into the regulation the 1977 Edition of Section XI of the ASME Code and addenda through the Summer 1978 Addenda. These provisions would also provide more flexibil'ity for-inservice inspection of pipe. welds in operating facilities and facilities in the construction stages and would avoid potential conflict between the code and the technical specifications concerning examination requirements for steam generator tubing.

The proposed amendment would also include several minor and clarifying amendments, including a change in the time interval for revising inservice inspection programs for operating facilities. The time interval would be.

extended from 40 and 20 months to 120 months to make implementation of the regulation more consistent with code requirements and to save time and effort.

Extending the time interval is not considered a significant relaxation of safety requirements since new code changes generally deal with practical considerations and the application of new developments.

Further, new code changes could be imposed at any time. if safety considera-tions so dictate.

Meeting of the Interagency Task Force on Radiation Mr., Robert'B. Minogue and other representatives from NRC attended a meeting of the _ Interagency Task Force on Ionizing Radiation Research and Regulation.

Peter Libassi, General Counsel, HEW, who is leading this effort, carled the meeting to allow for a final review and discussion of the Task Force Work Group reports and recently developed summaries of these reports as well as the procedure and schedule for releasing these reports for public comment.

Four, if not all five, of the' Work Group reports and their summaries are expected to be released for public comment, including formal coment by Federal agencies, sometime between January 30 and February 2.

Also discussed were the procedure and schedule for developing the Task Force's summary report to the White House and the content of this report. There was much discussion of what this report shouH contain and recommend relative to the Federal government organization (institutional) aspects of coordinating research and controlling exposures to ionizing radiation; no clear cut conclusions on this were reached at the meeting..The present schedule calls for submitting the summary report and recommendations to the White House and/or releasing it for public comment on March 30, 1979.

NRC-EPA Joint Hearing on Occupational Radiological Health Standards As reported last week, EPA officials have agreed in principle on joint participation in a fact-finding hearing on occupational radiation health standards. On January 19, 1979, NRC staff members met with EPA staff personnel to work out hearing details. As viewed by EPA staff, the primary purpose of the hearing, which is to be chaired by EPA, is to obtain public comment on new occupational radiation protection guidance for Federal agencies, now being developed by EPA. They exoect to publish this guidance for comment, and announce the hearing, in April.

The hearing would then take place in June.

EPA staff felt that the scope of issues to be considered at the hearing should be limited to issues raised in their new guidance document. NRC staff agreed, on the basis that this approach would inevitably lead to consideration of the full range of basic health risk issues and the adequacy of present standards.

We intend to assure that the Federal Register notice announ~cing the herring is clear on the point that the scope will include the full range of health risk issues.

The hearing will be presided over by a member of the EPA General Counsel staff with'-a 6 to 8 member panel to ask questions of those who testify.

The NRC will be represented on this panel. The composition of the rest of the panel was discussed, but not settled on, at the meeting.

The hearing will not include cross examination. The hearing panel will make no." findings"; rather, its function is fact-finding: to assure a fair airing bf all issues and the development of a complete transcript of the proceedings.

ELD is being asked to determine whether this form of hearing is compatible with the NRC's policy and procedures for hearings and would satisfy the NRDC request for a hearing in PRM-20-6.

Additional meetings are planned to work out further details.

radioactive material shipments transported in Virginia to a delegate in the Ho0se of Delegatas of the State of Virginia.

The delegate is sponsoring a bill to.equire advance notification of certain radioactive shipments considered to b.e very hazardous if involved in serious accidents.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending January 26, 1979

. Union Carbide Gas Hills Uranium Mill DES Published The Uranium Mill Licensing Section has issued a Draft Environmental Statement on the environmental considerations associated with the application of the Union Carbide Corporation for a renewal of its license to operate their Gas Hills uranium mill. The mill is located about 60 miles west of Casper in Natrona County, Wyoming.

The applicant proposes to

, crease the mill capacity from 465,000 tons of uranium ore 'per year to 500,000 tons.

In addition, Union Carbide proposes to build and operate two heap leaching facilities for the initial processing of low grade ore, one at the mill site and the other in nearby Fremont County, about ten miles west of the mill site.

FES Published for the Atlas Minerals, Moab, Utah, Uranium Mill The Final Environmental Statement (NUREG-0453) related to operation of the Atlas Minerals Division, Moab, Utah, uranium mill was published by the Uranium Mill Licensing Section. The mill has operated for about 20 years. The FES concludes that the license should be renewed, a~nd the statement includes various mitigating actions for continued operations at this site.

Waste Management Licensing Study A first draft of the report was issued for review and comment.

The draft is under concurrent review by the Commission, NRC staff, DOE, and other Federal Agencies. A final report is scheduled to be delivered to the Commission by-February 15 and to the Congress by March 1.

Preliminary Notifications relating to the following actions were dispatched during the past week:

a.

PN0-79-10 Duane Arnold - Nonconforming Welds in Safe End Repairs -

Preliminary findings by NRC inspectors, assisted by NRC consul-tants, during inspections conducted at the site indicate. hat seven welds on five of the eight safe ends under repair to not meet code requirements. The NRC inspectors are concerned with the existence of crevice-like conditions in the root of the welds which may be potential sites for subsequent stress cor-rosion attack similar to that which led to the original shutdown and repairs. The licensee was informed that the NRC does not agree with the 1-icensee's finding that the seven welds are accept-able. Operation of the reactor will be delayed until the weld quality related problems are resolved.

PNO'79-11 Zion Units 1 and 2 - NRC Region III Director Subpoenaed to Testify in Criminal Court Proceeding - The Director of Region III (Chicago) learned on January 19, 1979, that he is being served with a subpoena to testify as a witness for the defense in a criminal court trial involving the arrest of 20 individuals for unlawful tres-passing during a peaceful demonstration at the Zion Station in October 1978. On January 23, 1979, the attorney for the defendants notified the Regional Director that the subpoena was being torn up and that it would not be necessary for the director to testify.

According to the attorney, the decision was based on the conclusion that the Regional Director's testimony may not prove beneficial.

PNO-79-12 Calvert Cliffs Unit 2 - Unscheduled Shutdown to Repair D6maged Seals on Reactor Coolant Pump and Degraded Reactor Coolant System Pressure' Boundary - The Unit 2 reactor was manually tripped due to excessively high seal temperatures on a reactor coolant pump.

Repairs to the pump and weld joint will result in an estimated one-week shutdown..

Power Burst Facility The Power Burst Facility (PBF) ran an important control-rod-system-type test, designated RIA 1-2, on December 1,1978..The objective of this test was to determine the effect of burnup on the failure threshold of four~ pre-irradiated (5000 MW days /Tonre) fuel rods subjected to reactor transients. The preliminary test report said that there was general retention of the integrity of the four rods, based on the internal fuel rod gas pressure and post-test fission product activity in the loop.

More recent visual inspection shows that three test rods which'were fitted with plenum fill gas pressure transducers are intact, but that a fourth test rod without a pressure transducer has a large. number of longitudinal cladding cracks.

The apparent difference between the cracked rod and the three intact rods is as follows: before the test, when the pressure transducers were placed on the three intact rods, it was necessary to replace the irradiated, fission-product-rich fill gases with a nonradioactive fill gas of equivalent thermal conductivity.

It is thought that the fission product inventory of the gap between the fuel and the cladding in the cracked fuel rod may have contributed to the observed clad cracking.

Failures of the type observed in operating reactors are usually described as caused by pellet-cladding interaction.

ITEMS OF INTEREST FOR THE WEEK ENDING JANUARY 20, 1979 Diablo Canyon Nuclear Power Plant, Units 1 and 2 On January 23, 1979 the Appeal Board issued a Memorandum and Order reversing a Licensing Board ruling denying Intervenors' motion to subpoena ACRS consultants whose views differed from the ACRS and the NRC staff. The Appeal Board found that " exceptional circumstances" justified issuing subpoenas. The Board rested its determination on its finding that Diablo was a plant designed and built on one set of seismic assumptions which underestimated the magnitude of potential earthquakes subsequently discovered and that the reanalysis and post hoc conclusions that the plant is safe as built are based on theories partly untested and previously unused for licensing purposes.

Jamesport N'uclear Power Station, Units 1 and 2 On January 25, 1979 the Appeal Bo:rd issued a Memorandum and Order (ALAB-521) denying Suffolk County's request for a stay of the licensing Board's Initial Decision authorizinj the issuance of construction per-mits. The Appeal Board noted that the Applicant could not commence

. construction until it received approval from the State of New York, thus the County could not show any injury at all resulting from the absence of a stay.

North Anna Nuclear Power Station, Units 1 and 2 (SFP)

On January 29, the Appeal Board (ALAB-522) reversed the Licensing Board's December 19, 1978 Order denying two intervention petitions for lack' of standing.

It held that the Licensing Board had erred in imposing on petitioners an obligation to show a causal relationship between interest and the possible results of the proceeding. Under established Commission practice. petitioners close proximity to a proposed or actual facility h?s been enough to establish interest.

Petitioners here lived in close proximity to the facility.

ITEMS OF INTEREST 0FFICE OF INTERNATIONAL PROGRAMS WEEK ENDING JANUARY 26, 1979 INTERNATIONAL COOPERATION Foreign Assignees

1. Arrangements are being made to extend the assignment of Mr. Roberto Trevino, a Mexican national, to work with the staff in Reactor Safeguards.

Mr. Trevino has been working with the Division of Project Management since January 1978.

2. Mr. Osnan M. Mersin, a Turkish national, is expected in early March to start a one-year assignment in DSS /ASB.

Foreign Reports Deleted from PDR copy.

EXP0RT IMPORT AND INTERNATIONAL SAFEGUARDS On January 25, an IP representative attended the first formal meeting of the NRC Safeguards Agreement Implementation Group (SAIG), formed to coordinate implementation of the US/IAEA Sefeguards Agreement. The principal' topic of discussion was the progress of proposed Part 75 to implement the Agreement for NRC licensees.

An IP representative attended a meeting of the Department of State on January 26 to discuss issues related to the final meeting in Vienna in early February on the International Convention on the Physical Protection of Nuclear Material.

. Agreements for Cooperation - Canada and Australia H. Schechter att' ended on January 24 and January 26 two interagency meetings

-at the Department of State aimed at reaching agreement on a number of issues in draft amended agreements for cooperation with Canada and Australia, in preparation for the upcoming negotiations with these countries.

Agreement was reached on most of the text in the agreements. Several un-resol.ved questions remain to be resolved by NRC and DOE personnel over the next few days.

.On January'17 and 18, the Region V State Liaison Officer was briefed by Arizona Energy and Radiological Health official on various Arizona-NRC matters of mutual interest including State government reorganization efforts and uranium mill licensing activities.

During-the visit to Phoenix NW. Robart also visit'ed Palos Verdes Nuclear Power Plant.

Emergenc y Preparedness Robert JeFayette participated in the Department of Transportation's Annual Emergency Transportation Planning Conference.

This meeting brings together many of DOT's regional personnel to discuss issues of interest to the Office of Emergency Transportation.

DOT participation in the Federal in'teragency concurrence in State radiological emergency response plans was discussed.

Messrs. Ryan and Sanders visited a DHUD location in the Ral'eigh-Durham,. area which is a candidate for the emergency operating facility of NRC's executive team Charlie.
