APPENDIX A NOTICE OF VIOLATION Industrial Inspection License No 34-14071-01 Industries, Incorporated Based on the inspection conducted on February 11, 1980 and July 29-30, 1980, it appears that certain of your activities were not conducted in compliance with NRC requirements as indicated below.

Items 1 through 7 are infractions.

1.

10 CFR 20.105(b) requires that radiation levels in unrestricted areas be limited so that if an individual were continuously present in the area, he could not receive a dose in excess of 2 millirems in any hour.

Contrary to this requirement, on February 11, 1980, the day of the inspection, radiation levels existed outside your radiographic cell in Erie, Pennsylvania such that an individual, continuously present in the area, could receive a dose in excess of 2 millirems in an hour.

10 CFR 20.201(b) requires that such surveys be conducted as may be necessary for you to comply with all sections of Part 20.

Contrary to this requirement, as of February 11, 1980, the date of the inspection, you failed to make such surveys as were necessary to assure compliance with 10 CFR 20.105(b), " Permissible levels of radiation in unrestricted areas."

Specifically, you failed to make such surveys as were necessary to ensure that the radiation levels outside your radiographic cell in Erie, Pennsylvania, were less than 2 millirem in any one hour.

10 CFR 20.101(a) limits the whole body exposure of an individual in a restricted area to one and one quarter rems per calendar quarter, except as provided by 10 CFR 20.101(b).

Paragraph (b) allows a whole body exposure of three rems per calendar quarter provided certain conditions are met.

Contrary to this requirement, one individual working in a restricted area received a whole body radiation dose of 1.320 rems during the third quarter of 1979 and the conditions of (b) were not met, another 1 received a whole body radiation dose of 3.230 rems during indivic 2

the second quarter of 1980.

License Condition No. 16 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in application dated May 28, 1976.

Procedures submitted in support of application dated May 28, 1976 references " Radiographic Operation Manual" - RSM-1, Manual No. 2.

Procedure No. RS-GP-5, page 2, of the above referenced manual requires a physical radiation survey of a projector and guide tube be con-ducted after each radiographic exposure to assure that the source returned to its properly shielded position.

Contrary to the above requirement, it was learned through statements of licensee representatives that the requirement was not met.

Speci-fically, on June 18, 1980, at a construction site in Rumford, Maine, two Radiographers failed to perform an adequate survey of the projector and guide tuoc after a raciographic exposure. This failure to perform an adequate survey led to an overexposure of 3.23 rems to one of the Radiographers.

License Condition No. 16 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in application dated May 28, 1976. Procedures submitted in support of application dated May 28, 1976 references " Radiographic Operation Manual" - RSM-1, Manual No. 2.

Procedure No. RS-GP-15, page 1, No. 3.2 and 3.3 requires a quarterly audit on each Radiographer and Assistant Radiographer and these quarterly audits be recorded on Form No. NC-0-63.

Contrary to the above requirement, it was learned through statements of licensee representatives that this requirement was not met.

Speci-fically, quarterly audits were not made for two Radiographers during the first and second quarter,1980.

License Condition No. 16 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in application dated May 28, 1976. Procedures submitted in support of application dated May 28, 1976 references " Radiographic Operation Manual" - RSM-1, Manual No. 2.

Procedure No. RS-C?-13, page 1, No. 2.1 of the above referenced manual requires that leak tests be performed by authorized individuals as documented on Industrial Inspection Industries, Inc.'s Form No. NC-0-81.

Industrial Inspection Industries Incorporated Contrary to the above requirement, it was determined through statements of licensee representatives and review of authorization records that this requirement is not being met.

Specifically, on September 20, 1979, November 27, 1979 and January 22, 1980 leak tests were performed by individuals not authorized by the pro-cedures described in the Radiographic Operational Manual.

7.

10 CFR 34.29(b) requires each permanent radiographic f acility entrance that is used for personnel access to the high radiation area shall have both visible and audible warning signals to warn of the presence of radiation. The audible signal shall be actuated when an attempt is made to enter the installation while the source is exposed.

Contrary to the above requirement, it was determined by observation of the NRC inspector that this requirement is not being met.

Specifically, on the day of the inspection at your North Canton, Ohio facility, the permanent radiographic facility was equipped with a visible warning device only.
