This refers to the routine inspections conducted by Mr. F. Cos? llo of our Region I office, on February 11, 1980, at your Erie, Pennsylvania facility, and Mr. D. G. Wiedeman of our Region III office, on July 29-30, 1980, at your North Canton, Ohio, f acility authorized by NRC Byproduct Material License No. 34-14071-01 and to the discussion of our findings with Mr. A. Magno by telephone on August 11, 1980.

The inspection was an examination of activities conducted under your license as they relate to radiation safety and to compliance with the Commission's rules and regulations and with the conditions of your license. The inspection consisted of a selective examination of pro-cedures and representative records, observations, independent measure-ments, and interviews with personnel.

In addition to the above areas, the inspectors examined actions described in your letter dated March 26, 1979, regarding apparent items of non-compliance found during our February 22, 1979 inspection. We have no further questions regarding these matters.

During this inspection, certain of your activities appeared to be in noncompliance with NRC requirements, as described in the enclosed Appendix A.

Regarding items No. I and 2, your letter dated March 7, 1980 describes your corrective action taken for these items, therefore, no additional written response will be necessary for these two items.

At the conclusion of the inspection you assured our inspector that you would make every reasonable effort available to correct the items of noncompliance found during this inspection. For these reasons we are not taking any escalated enforcement action at this time. Our future inspections will further evaluate the effectiveness of your control over licensed activities. Should these inspections identify additional significant noncompliance, escalated enforcement action may be taken.

1 This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations. Section 2.201 requires you to submit to this office within twenty days of your receipt of this notice a written statement or expla-nation in reply, including for each item of noncompliance, except noncompliance item Nos. 1 and 2 of Appendix A: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved.

In addition to our concern for your corrective action with respect to the specific items of noncompliance noted, we are concerned about your manage-ment control system that has permitted these items to occur.

Consequently, in your reply to this letter, please describe what ac*. ion will be taken or planned, to improve the effectiveness of your management control over your present and future licensed activities, so as to preclude the recur-rence of these or similar items of noncompliance.

We will gladly discuss any questions you have concerning this inspection.
