Dear Mr. Pollock:

This is to inform you of the current status of your petition for rulemaking (Docket Number 71-6) concerning emergency response for transportation acci-dents involving radioactive materials.

In a letter to you dated June 16, 1978, I stated that the staff will consider your petition after NRC reaches final conclusions on the NRC-00T special study of the transportation of low specific activity materials (sometimes referred to as the Wirth Study). The draft report of that special study has just been released for public coments. Those coments must be taken into account be-fore we reach the final conclusions. A copy of the draft report is enclosed.

On August 17, 1978, the Materials Transportation Bureau (MTB) of the Depart-ment of Transportation published an Advance Notice of Proposed Rulemaking on highway routing of radioactive materials. The notice stated that the MTB is considering the need and possible method for establishing routing require-ments under the Hazardous Materials Transportation Act applicable to highway carriers of radioactive materials and invites public comments to assist the MTB in deciding what Federal action may be justified. Subsequently, a public hearing on the proceeding was held on November 29, 1978, in which you parti-cipated and presented your view.

The first part of your petition concerns the use of special routes for the transportation of radioactive materials. The staff believes it is appropri-ate therefore, to forward a copy of your petition and the 40 public coments received on the petition to MTB for its consideration in connection with MTB's rulemaking proceedings on routing (Docket Number HM-164). Enclosed is a copy of a letter forwarding these documents to MTB.

We will comunicate with you further regarding the petition upon completion of the NRC-00T special study.
