This office has received a copy o' your February 23, 1979 Supplement One to Proposed Change No. 74 which you filed with the Office of Nuclear Reactor Regulation for review and approval. Supplement One proposed Environmental Technical Specification changes for the Vermont Yankee Nuclear Power Plant (License No. DPR-28) which supersede the remaining portion of Proposec Change No. 74 dated August 16, 1978.
In your February 23, 1979 filing, you stated that in ycur opinion no additional fee payment is required because this filing merely modifies your August 16, 1978 application for which you paid a Class III fee.
On October 13, 1978, Amendment No. 48 to License No. DPR-28 was issued which authorized a portion of your August 16 request. We have been advised by the NRR review staff that your February 23 Supplement One modifies significantly the remaining portion of your August 16, 1978 application. Because Supplement One significantly modifies your original request and involves, within itself, a separate single environmental issue, it requires a Class III amendment fee cf $4,000.
It is isquested that your office forward the $4,000 amendment fee promptly to this office.
If after the final evaluation of your application is completed it is determined that it was incorrectly classified, you will be refunded any overpayment or billed for any additional amount due.
