SUBJECT:
RELEASE OF INFOP31ATION INITIALLY CLAIMED PROPRIETARY By your affidavit and application dated June 9, 1978 and June 29, 1978 respectively, you submitted responses to certain NRC requests for additional information on Midland Plant, Units 1 and 2 relating to Babcock and Wilcox fuel.
You requested that these responses be withheld from public disclosure pursuant to Section 2.790 of 10 CFR Part 2.
Our findings regarding the proprietary claims for the material submitted were provided by my letter of December 7, 1978.
The findings supported the claim for part of the material provided.
However, for the information submitted in response to our requests numbered 231.10 and 231.13, we found that the affidavit was not in conformity with Section 2.790(b) and we stated that:
"In accordance with Section 2.790(c) of 10 CFR Part 2, the information sought to be withheld will be placed in the Commission's Public Document Room 30 days after the date of this letter unless you either seek to withdraw the information reques ted to be withheld or provide the Nuclear Regulatory Commission with an amended affidavit meeting the requirements of Section 2.790(b) to 10 CFR Part 2."
