Dear Mr. Staiger:

This letter will confirm our telephone conversation today regarding the Miami Valley Power Project's ("P ro j ec t")

response to the Applicant's interrogatories which were filed in the captioned proceeding on December 19, 1978. You in-formed me that you, and not Mr. Schumacher, would be preparing the Project's response to the interrogatories. You recognized that under the Nuclear Regulatory Commission's Rules of Practice, your response was due today, but stated that answers had not yet been prepared. You stated, however, that you had intended to request an extension of time to respond. I confirmed with you the fact that the interroga-tories had been sent to the proper address and had been received by your organization.

In order to expedite the proceeding, I stated that we would not object to a one week extension of time until January 16, 1979 for you to complete and file your response, but would not accept any further delay. I wish to emphasize that we expect complete reaponses to the interrogatories and would move the Licensing Board to impose sanctions, including possibly dismis. sal of the Project from the proceeding, should your responses not be timely or responsive.
