In accordance with Marvin Peterson's telephone conversation on February 22, 1979 with Mort Hersch and Robert P. Keenan, we have modified Westinghouse's export application dated January 16, 1979, Reference No. ICS-8063, to clarify the types of items which can be exported to Framatome under license XCOM0142.
This letter will confirm these understandings. As a component export license, XCOM0142 authorizes Westinghouse to export only those parts and components specially designed or prepared for use in nuclear reactors which are not also defined as a utilization facility in section 110.2(ss) of Part 110. Accordingly, only components of primary coolant pumps (Item 5),
fuel charging or discharging machines (Item 2), and control rods (Item 3) are authorized for export under license XCOM0142. Complete primary coolant pumps, fuel charging and discharging machines and control rods can only be exported under the authority of facility export licenses, which have dif-ferent review and approval requirements than component export licenses.
The NRC will note these understandings on your application letter.
Based on a subsequent telephone conversation on February 23, 1979 between Elaine Hemby and Mort Hersch concerning a similar Westinghouse component export license application to Japan dated January 25,1979 (XCOM0150),
Reference No. ICS-8111, we are also modifying this application to clarify the types of items which can be exported and are noting the same understandings on this application.
