Dear Sir:

This is a Request under the Freedom of Information Act ("Act")

5 U.S.C. 5552. This Request is made on behalf of the People of the State of Illinois, by their attorney, William J. Scott, Attorney General of the State of Illinois.

The subject of this Freedom of Information Act is the transport of spent fuel and other special nuclear material from the Quad Cities Nuclear Reactor and other nuclear facilities.

This Request seeks all records, studies, models, analyses, reports, tests, documents, correspondence, memoranda, inspection reports and notes, accident or incident reports and notes, etc. , whether in draf t or in final form pertaining to the following:

1. Sabotage, terrorism, and security related to the packaging and transportation of spent nuclear reactor fuel and other special nuclear ma te ria l .
2. Acts of sabotage or terrorism or a breach o# security; the possibility of such events occuring and the consequences or hypothetical consequences of such events.

. 3. The ability of the spent fuel or special nuclear material containment systems to withstand acts of sabotage or terrorism or a breach of security.

4. NUREG 0194 " Calculations of Radiological Consequences from Sabotage of Shipping Casks for Spent Fuel and High Level Waste."

Because none of the statutory exemptions from the Act's manda-tory disclosure provisions apply, access to the requested records should be granted within ten (10) working days. In the unlikely event, however, that access denied to any part of the requested records, please describe the deleted ma terial in detail and specify the statutory basis for the denial as well as your reasons for believing that the alleged statutory justification apply in this instance. Please separately state your reasons for not invoking your discretionary powers to release the re-quosted docements in the public interest.

We anticipate that you will make the requested materials avail-able within the statutory prescribed period. We also request that you waive any applicable fees since disclosure meets the statutory standard for waiver of fees in that " furnishing the information can be considered as primarily benefitting the general public." 5 U.S.C.A. S552 (4) (A) .
