Dear Sir:
The purpose of this letter is to forward te you a check in the amount of $1,200.00 as payment for the licensing review of Proposed Change No. 167. This change relates to secondary water chemistry monitoring which was submitted September 24, 1979, Reference (b).
Yankee Atomic Electric Company believes that the Commission's revised fee schedule is illegal, and is considering an appeal to the United States Supreme Court of the recent decision of the United States Court of Appeals for the Fifth Circuit. Accordingly, the license fee filed herewith is submitted,under protest mand without waiver of the Company's right to contend that it should be refunded in whole or in part.
This fee payment was requested in your letter dated November 6, 1979, Ref erence (c). Should you have any questions relative to this matter, please contact us.
