Pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, this report is submitted in reply to your letter of March 21, 1979, which informed the Northeast Nuclear Energy Company of one apparent item of noncompliance with NRC regulations.
Nonconformance Item:
10 CFR 73.55(d) (1), Access requirements, states in part:
"The licensee shall control all points of personnel and vehicle access into a protected area.
Identification and search of all individuals shall be made.... The search function for detection of firearms, explosives, and incendiary devices shall be conducted either by a physical search or by use of equip-ment capable of detecting such devices..." Millstone Procedure SEP 1201, Revision 9 dated December 26, 1978, Material and Package controls, specifies in paragraph 6.5.1.3, Personnel Access, Protected Area, Personnel Searches, that:
" Searches for firearms... at all personnel access points are con-ducted through the use of metal detection equipment..."
