Memorandum to the File STAFF CONCLUSIONS REGARDING LICENSE TO EXPORT SPECIAL NUCLEAR MATERIAL TO SWITZERLAND (XSNM00953, Amendment No. 03)
In August 1978, Transnuclear, Incorporated applied for a license amendment to export low-enriched uranium to Belgium for fabrication purposes for ultimate use as reload fuel in the Beznau I Nuclear Power Plant located in Switzerland.
In response to our August 16, 1978 request for views, the Executive Branch (1) concluded that issuance of the license would not be inimical to the comon defense and security, and (2) confirmed that the material will be subject to all the tenns and conditions of the Aiditional Agreement for Cooperation between the US and EURATOM.
These views and license application analysis by the Ex cutive Branch were forwarded by State Department memorandum of February 23, 1979.
Confirmation of the applicability of the US-EURATOM Agreement was set forth by letters dated September 18, 1978 and February 7,1979 from the EURATOM Delegation.
The material requested under application XSNM00953 is low-enriched uranium intended for routine reload of the Beznau I reactor.
Under 10 CFR 110.40(b)(2) the staff is authorized to issue export licenses to receive fuel has been issued.
Export licenses have been issued previously for fueling the Beznau facility.
The Commission, in reviewing prior export license applications to Switzerland (e.g. XSNM01344 issued February 16,1979) has determined that Switzerland meets the applicable export licensing requirements of 10 CFR 110.44(a)(1).
The staff has found that there are no material changed circumstances associated with the subject application from those existing at the time of issuance of XSNM01344 therefore, the license may be issued under the authority contained in Section 126(a)(2) of the Atomic Energy Act and 10 CFR 110.44(a)(2).
