02894 Gentlemen:
This refers to your February 19, 1979 letter (RG 79-61), which informed us that the $8,300 amendment fee requested in our February 13, 1979 letter was not required since the guard training and qualifications plan is a change which does not decrease the effectiveness of your security plan per 10 CFR 70.32(e).
Section 70.32(e) of Part 70 clearly allows a licensee on his can initiative to make certain changes to a security plan without prior Cormission approval; however, those changes do not include a licensee's compliance with new requirements promulgated by Commission regulations which require review and approval.
Your guard training and qualifications plan was nct filed pursuant to 70.32(e), but rather, the plan was submitted in accor-dance with the requirements of 10 CFR 73.50(h) and Appendix B of Part 73.
Thus, licensees are required by regulation to file these plans for Commis-sion review and approval.
Footnote 1(d) of s170.31 of the enclosed Part 170 provides in part that, amendments which result from NRC written requests may be exempt from fees when the amendment is issued for the convenience of the Commission.
Your compliance with the requirements of the Commission's regulations is not considered as complying with an NRC written request of the type referred to in Footnote 1(d).
In addition, the review and approval of the subject plan is not being done for the convenience of the Commission.
Therefore, we do not consider the filing of your guard training and qualifications plan for review and approval as exempt from fees.

United fluclear Corporation The Licensing staff has informed us that the review of the plan will require a major review effort and a specific amendment to the license, if approved.
You are requested to remit the $8,300 amendment fee as requested in our February 13, 1979 letter.
Upon receipt of the fee, we will forward your guard training and qualifications plan to the Licensing staff for processing.
When reviev of the plan is complete, we will notify you of the actual costs incurred in the review and, if necessary, refund any overcharge.
If you have additional questions concerning this matter, please let us know.
