We received your February 26, 1979 letter, and documents for updating your 1976 application for a special nuclear material license. Our Licensing staff currently has the documents for review.

You requested that we review your payment of the $10,300 application fee in light of the Commission's revised fee schedule, copy enclosed, and refund any possibic application fee overpayment.

No refund of the application fee is due since fees are due and payable under the schedule of fees in effect at the time an application is filed.

When your application was filed in February 1976, the fee for an application filed under Category l A of Section 170.31 was $10,000 + $10/kg of special nuclear material.

Your request for possesion and use of 30 kgs of special nuclear material, therefore, required an application fee of

$10,300 ($10,000 + $10 x 30 kgs).

If you would have filed your request under the Commis:; ion's current fee schedule, your application would be subject to fee Category 1D of Section 170.31. The total fee for the issuance of a license in this category is $34,600 ($3,000 - Application fee, $31,600 - New License fee) as compared to the $10,300 application fee which you paid. Since your application was filed prior to the revised fee schedule, however, no additional application fees are required.

We will review the license when it is issued to determine the fee classification under our current fee schedule.

Please note that fees are now charged for amendments to licenses (Section 170.31) and for license inspections (Section 170.32).
