Dear Mr. Caldwell:
The Com. mission has issued the enclosed Amencment No. 5 to Facility License No. R-120 for the North Carolina State University PULSTAR research reactor in response to your request dated January 31, 1979.
inis amendment revises the provisions in the facility license relating to the authorized quantity of special nuclear material.
This change is necessary to correct an error which occurrec during prepara*. ion of the facility license based on your application for a license under 10 CFR Part 70, dated Acril 9,1970. The error was in stating the possession limit in terms of uranium dioxide rather than uranium.
Because tnis was an ecitorial error, the change is acriri s trativ e.
Since the amendment applies only to administrative details, it dces not involve significant r.aw safety informaticn of a type not consi-dered by a previcus Ccmmission safety review of the facility.
It. does not involve a significant increase in the orobability or consepuences of an accident, does not involve a significant decrease in a safety targin, and therefore does not involve a significant hazards consi-deration. We have also concluded that there is reasonaole assurance that the health and safety of the public will not be endangered by nis action.
We have evaluated the potential for environmental impact cf plant operation in accordance with the enclosed amendment. We have deter-mined that the amendment dces not authorize a change in effluent tyces or Octal a.mcunts nor an increase in power level, and aill not result in 7903280101 s
Mr. Jchn T. Caldwell any significant environmental iccact. Havir; made this deter-mination, we have further concluded that the amencrent involves an action which is insignificant from the standocint of environmental impact and pursuant to 10 CFR s51.5(d)(a) that an environmental impact statement, or negative declaration and environmental imcact appraisal need not be prepared in connection with the issuance of this amendment.
