Appendix A NOTICE OF VIOLATION Nite-Site, Incorporated License No. 22-13585-02G License No. 22-13585-03 Based on the inspection conducted on January 24, 1979, it appears that certain of your activities were in noncompliance with NRC requirements, as noted below.
Item 1 is an infraction and item 2 is a deficiency.
License No. 22-13585-02G 1.
License Condition No. 2 of NRC Byproduct Material License No.
22-13585-02G requires that all gun sights be installed on guns by Nite-Site, Inc.
Contrary to this requirement, as of the date of this inspection, the Nite-Site, Inc. was distributing gun sights and the general licensees were installing them on their weapons.
License No. 22-13585-03 2.
Paragraph 10 CFR 20.203(e)(1), Title 10 of the Code of Federal Regulations, Part 20, requires in part, that area or room inwhich licensed material is stored and which contains any radioact.ve material in an amount exceeding 10 times the quantity of such material specified in Appendix C of this part shall be conspic-uously posted with a sign bearing the radiation caution symbol and the words:
CAUTION RADI0 ACTIVE MATERIALS.
Contrary to this requirement, on the date of this inspection, the locked cabinet containing the stored promethium-147 gun sights was posted with DOT labels and not the required sign.
This is a repeat item of noncompliance.
