Gentlemen:

This office has received a copy of your March 20, 1979 request which you filed with the Office of Nuclear Reactor Regulation for review and approval. The submittal included a proposed hydrostatic pressure testing program fcr Browns Ferry Unit 1 (Facility License No. DPR-33) and requested relief from the testing requirements of Section XIof the ASME Boiler and Pressure Vessel Code for the facility.

Your request was not accompanied by an approval fee as prescribed by Section 170.22 of 10 CF2170.

Requests for approvals such as that identified above should be classified in the same manner as applications for license amendments in Section 170.22.

Section 170.12(c) requires that tion of the amendment (approval)your company provide a proposed determina-class, state the basis therefor, and submit the fee with your application for the approval or amendment.

We have determined from our preliminary review that the requested action falls in fee Class III ($4,000) because the relief requested involves consideration of a single safety issue.

You should'promptly forward $4,000 to this office.

If a.:ar the final evaluation of your application is completed it is determined that it was incorrectly classified, you will be refunded any overpayment or billed for any additional amount due.
